Terms of Use

Zavidovo Resort is published on the Apple App Store by Sport Star Management LLC (OOO «Sport Star Management», OGRN 1097746525898), a company registered in the Russian Federation, with its registered office at 34 Verkhnyaya Krasnoselskaya Street, Moscow, 107140, Russia, and on Google Play by Highglossy FZE, a company registered in the United Arab Emirates, with its registered office at Al Shmookh Business Center, One UAQ, UAQ Free Trade Zone, Umm Al Quwain, U.A.E.. The company that distributes the copy you installed is the operator of your data and your counterparty under these documents; we refer to it as “we” or “us”. Both companies are part of the Highglossy group and apply this document in full.

By downloading, installing or using Zavidovo Resort, you agree to these terms. If you do not agree, do not use the app. Our handling of personal data is described in the Privacy Policy, which forms part of this agreement.

You must be at least 16 years old and able to enter a binding contract where you live. If you are using Zavidovo Resort on behalf of an organisation, you confirm you are authorised to bind it to these terms.

The guide, routes and events need no account. The loyalty account is created with your phone number or email under the resort's programme rules, which govern how points are earned, spent and expire. You can delete the account from the app's settings; the resort keeps the records its rules and the law require.

Keep your sign-in details to yourself: points spent from your account are spent by you.

The Zavidovo Resort app is an interactive guide to the year-round resort and its loyalty programme: activities, restaurants and hotels with calls and bookings, walking and cycling routes with guidance, a calendar of events, weather, offers and points for spending.

The app is not the seller of any service at the resort: tables, rooms, activities and goods are sold by the restaurants, hotels and the resort under their own terms, and a booking made through the app is a booking with them. Route guidance is an aid, not a safety system: watch the terrain, the weather and the signs. Weather and opening hours are provided as information and may be out of date.

The guide's texts, photos, maps and the resort's marks belong to the resort and its licensors; you may view and share them through the app's share functions for personal, non-commercial purposes.

You must not:

• Attempt to gain access to another user's account, data or key material.
• Probe, scan or test the vulnerability of our systems without our prior written consent, or otherwise interfere with their operation.
• Use automated means to create accounts or place load on the service beyond normal app use.
• Reverse engineer, decompile or disassemble the app, except to the extent that applicable law expressly permits it despite this restriction.
• Resell, sublicense or make the service available to third parties as your own.

We may suspend or terminate an account that breaches this section.

The app is free and has no in-app purchases. Points in the loyalty programme are granted and redeemed by the resort under its programme rules; they are not money, cannot be withdrawn or transferred, and expire as those rules say. Payments for restaurants, hotels, activities and goods are made to those venues directly, under their own terms, refund rules and cancellation policies. The app does not take payments.

Where you obtained Zavidovo Resort from the Apple App Store, the following applies and prevails over anything inconsistent elsewhere in these terms:

• This agreement is between you and Sport Star Management LLC only, not with Apple. We, not Apple, are solely responsible for Zavidovo Resort and its content.
• Apple has no obligation to furnish any maintenance or support for Zavidovo Resort.
• If Zavidovo Resort fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
• Apple is not responsible for addressing any claim by you or a third party relating to Zavidovo Resort, including product liability, failure to conform to legal requirements, and consumer protection or privacy claims.
• Apple is not responsible for the investigation, defence, settlement or discharge of any third-party claim that Zavidovo Resort infringes intellectual property rights.
• You confirm you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.

Where you obtained Zavidovo Resort from Google Play, your purchase and the delivery of the app are also subject to the Google Play Terms of Service. Google is not a party to this agreement and is not responsible for Zavidovo Resort, its content or support. Refunds for Google Play purchases are handled by Google under its own policies.

We aim to keep Zavidovo Resort available, but we do not guarantee uninterrupted service. We may suspend it for maintenance, and we may change or discontinue features. If we discontinue the service altogether, we will give you reasonable notice in the app or by any other means we have.

You may stop using Zavidovo Resort at any time and delete your account from within the app; deletion is irreversible. We may suspend or terminate your access if you breach these terms, if we are legally required to, or if continuing would expose us or other users to material risk. Except where a breach makes it inappropriate, we will give notice first.

To the fullest extent permitted by law, Zavidovo Resort is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that Zavidovo Resort will be uninterrupted or error-free, or that routes, weather, opening hours or offers will be accurate or up to date.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, and for fraud. If you deal as a consumer, your statutory rights are unaffected.

Subject to the section above, to the fullest extent permitted by law:

• We are not liable for indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, goodwill or anticipated savings.
• We are not liable for services booked or bought from the resort, restaurants, hotels or other venues, for the loyalty programme, or for incidents on a route.
• Our total aggregate liability arising out of or in connection with these terms is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, and (b) 50 EUR.

We may update these terms. The date at the top reflects the current version. Where a change materially affects your rights, we will give notice in the app before it takes effect. Continuing to use Zavidovo Resort after that point means you accept the change; if you do not, stop using the app and delete your account.

If you obtained the app from the Apple App Store, these terms are governed by the law of the Russian Federation and disputes are resolved by the competent courts of the Russian Federation. If you obtained it from Google Play, these terms are governed by the law of the United Arab Emirates and the courts of the United Arab Emirates have exclusive jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence, nor of the right to bring proceedings there.
