Terms of Use

SatGuard Security is operated by Sport Star Management LLC (OOO «Sport Star Management», OGRN 1097746525898), a company registered in the Russian Federation, with its registered office at 34 Verkhnyaya Krasnoselskaya Street, Moscow, 107140, Russia (“we”, “us”).

By downloading, installing or using SatGuard Security, you agree to these terms. If you do not agree, do not use the app. Our handling of personal data is described in the Privacy Policy, which forms part of this agreement.

You must be at least 16 years old and able to enter a binding contract where you live. If you are using SatGuard Security on behalf of an organisation, you confirm you are authorised to bind it to these terms.

Your account is created when you register with the code or invitation your company gave you. It is tied to your phone number and to that company. Your company's managers can suspend or remove it; you can also delete it from the app's settings, after which your company keeps only what the law obliges it to.

Keep your sign-in details to yourself: actions taken from your account during a shift are attributed to you.

SatGuard is a platform for security companies and their staff: schedules, shifts and tasks with routes on the map, telemetry, built-in chats, training materials, document expiry tracking, and a job market where guards apply to vacancies from every company on the platform.

SatGuard is not your employer and is not a party to your employment or service contract. It does not decide your schedule, pay or duties: your company does, and the app only shows and records them. Location and telemetry are collected to run the shift, not to monitor you outside it.

You keep every right in the documents, photos and messages you upload. By uploading them you let us store them and show them to your company, which is why they are there. Keep messages work-related and lawful; your company's managers can see them.

You must not:

• Attempt to gain access to another user's account, data or key material.
• Probe, scan or test the vulnerability of our systems without our prior written consent, or otherwise interfere with their operation.
• Use automated means to create accounts or place load on the service beyond normal app use.
• Reverse engineer, decompile or disassemble the app, except to the extent that applicable law expressly permits it despite this restriction.
• Resell, sublicense or make the service available to third parties as your own.
• Upload false documents or register on behalf of another person.
• Spoof your location or otherwise falsify shift telemetry.

We may suspend or terminate an account that breaches this section.

SatGuard is free for staff. There are no in-app purchases or subscriptions in the app; the platform is paid for by the companies that use it under their own agreements with us.

Where you obtained SatGuard Security from the Apple App Store, the following applies and prevails over anything inconsistent elsewhere in these terms:

• This agreement is between you and Sport Star Management LLC only, not with Apple. We, not Apple, are solely responsible for SatGuard Security and its content.
• Apple has no obligation to furnish any maintenance or support for SatGuard Security.
• If SatGuard Security fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
• Apple is not responsible for addressing any claim by you or a third party relating to SatGuard Security, including product liability, failure to conform to legal requirements, and consumer protection or privacy claims.
• Apple is not responsible for the investigation, defence, settlement or discharge of any third-party claim that SatGuard Security infringes intellectual property rights.
• You confirm you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.

We aim to keep SatGuard Security available, but we do not guarantee uninterrupted service. We may suspend it for maintenance, and we may change or discontinue features. If we discontinue the service altogether, we will give you reasonable notice in the app or by any other means we have.

You may stop using SatGuard Security at any time and delete your account from within the app; deletion is irreversible. We may suspend or terminate your access if you breach these terms, if we are legally required to, or if continuing would expose us or other users to material risk. Except where a breach makes it inappropriate, we will give notice first.

To the fullest extent permitted by law, SatGuard Security is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that SatGuard Security will be uninterrupted or error-free, or that a reminder or an emergency request will be delivered at a precise moment; keep the channels your company requires for emergencies.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, and for fraud. If you deal as a consumer, your statutory rights are unaffected.

Subject to the section above, to the fullest extent permitted by law:

• We are not liable for indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, goodwill or anticipated savings.
• We are not liable for decisions your company takes on the basis of data in the platform, including about your pay, schedule or employment.
• Our total aggregate liability arising out of or in connection with these terms is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, and (b) 50 EUR.

We may update these terms. The date at the top reflects the current version. Where a change materially affects your rights, we will give notice in the app before it takes effect. Continuing to use SatGuard Security after that point means you accept the change; if you do not, stop using the app and delete your account.

These terms are governed by the law of the Russian Federation, and disputes are resolved by the competent courts of the Russian Federation. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence, nor of the right to bring proceedings there.
