Terms of Use

These terms are the agreement between you and Highglossy FZE for the use of PubliShare. They cover what the app does, how teams and purchases work and what each of us is responsible for.
1.Agreement
PubliShare is operated by Highglossy FZE, a company registered in the United Arab Emirates, with its registered office at Al Shmookh Business Center, One UAQ, UAQ Free Trade Zone, Umm Al Quwain, U.A.E. (“we”, “us”).
By downloading, installing or using PubliShare, you agree to these terms. If you do not agree, do not use the app. Our handling of personal data is described in the Privacy Policy, which forms part of this agreement.
2.Eligibility
You must be at least 16 years old and able to enter a binding contract where you live. If you are using PubliShare on behalf of an organisation, you confirm you are authorised to bind it to these terms.
3.Your account
Working alone, PubliShare needs no account. To create or join a team you sign in, for example with Sign in with Apple; we do not issue passwords. A team's administrators control who belongs to it, the roles and the shared library. You can leave a team or delete your account from the app's settings; purchases stay with your Apple ID and can be restored.
You are responsible for keeping your device and your sign-in provider account secure, and for the people you invite into a team.
4.What PubliShare is, and is not
PubliShare is a tool for newsrooms and SMM teams: brand templates for every social network, editorial teams with roles, shared fonts, music and watermarks, and video cut and published from the app.
PubliShare is not a media archive or backup service: footage exists on your device and wherever you export it, and a team library holds only what the team uploaded. It does not publish on your behalf and does not store your social-network credentials.
5.Your content
You and your team keep every right in the templates, fonts, music, footage and videos you create or upload. We claim no ownership of them. By uploading something to a team library you grant us only the licence needed to store it and deliver it to that team's members, and you grant the team's members the right to use it within PubliShare. You confirm you have the rights to the fonts, music and footage you upload and that nothing you publish infringes anyone's rights or the rules of the platform you post to.
6.Acceptable use
You must not:
- Attempt to gain access to another user's account, data or key material.
- Probe, scan or test the vulnerability of our systems without our prior written consent, or otherwise interfere with their operation.
- Use automated means to create accounts or place load on the service beyond normal app use.
- Reverse engineer, decompile or disassemble the app, except to the extent that applicable law expressly permits it despite this restriction.
- Resell, sublicense or make the service available to third parties as your own.
We may suspend or terminate an account that breaches this section.
7.Purchases
PubliShare is free to download. The free version is limited; PubliShare Small and PubliShare Large are one-time purchases that unlock the tool for a single editor or for a whole team. The exact price for your region and currency is shown on the purchase screen before you confirm.
Payment is charged to your Apple App Store account on confirmation of purchase; we never receive or handle your payment details. One-time purchases do not renew. Restore Purchases in the app reattaches them to a new device signed in with the same store account.
Refunds are handled by Apple under its own policies. We cannot issue a refund for a store purchase. Where you have a statutory right of withdrawal under consumer law in your country, that right is unaffected by this section.
8.Apple App Store
Where you obtained PubliShare from the Apple App Store, the following applies and prevails over anything inconsistent elsewhere in these terms:
- This agreement is between you and Highglossy FZE only, not with Apple. We, not Apple, are solely responsible for PubliShare and its content.
- Apple has no obligation to furnish any maintenance or support for PubliShare.
- If PubliShare fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
- Apple is not responsible for addressing any claim by you or a third party relating to PubliShare, including product liability, failure to conform to legal requirements, and consumer protection or privacy claims.
- Apple is not responsible for the investigation, defence, settlement or discharge of any third-party claim that PubliShare infringes intellectual property rights.
- You confirm you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.
9.Availability
We aim to keep PubliShare available, but we do not guarantee uninterrupted service. We may suspend it for maintenance, and we may change or discontinue features. If we discontinue the service altogether, we will give you reasonable notice in the app or by any other means we have.
10.Termination
You may stop using PubliShare at any time and delete your account from within the app; deletion is irreversible. We may suspend or terminate your access if you breach these terms, if we are legally required to, or if continuing would expose us or other users to material risk. Except where a breach makes it inappropriate, we will give notice first.
11.Disclaimers
To the fullest extent permitted by law, PubliShare is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that PubliShare will be uninterrupted or error-free.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, and for fraud. If you deal as a consumer, your statutory rights are unaffected.
12.Limitation of liability
Subject to the section above, to the fullest extent permitted by law:
- We are not liable for indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, goodwill or anticipated savings.
- We are not liable for loss of footage or projects stored only on your device.
- Our total aggregate liability arising out of or in connection with these terms is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, and (b) 50 EUR.
13.Changes to these terms
We may update these terms. The date at the top reflects the current version. Where a change materially affects your rights, we will give notice in the app before it takes effect. Continuing to use PubliShare after that point means you accept the change; if you do not, stop using the app and delete your account.
14.Governing law
These terms are governed by the law of the United Arab Emirates, and the courts of the United Arab Emirates have exclusive jurisdiction over any dispute. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence, nor of the right to bring proceedings there.
