Terms of Use

meHappy is operated by Sport Star Management LLC (OOO «Sport Star Management», OGRN 1097746525898), a company registered in the Russian Federation, with its registered office at 34 Verkhnyaya Krasnoselskaya Street, Moscow, 107140, Russia (“we”, “us”).

By downloading, installing or using meHappy, you agree to these terms. If you do not agree, do not use the app. Our handling of personal data is described in the Privacy Policy, which forms part of this agreement.

You must be at least 16 years old and able to enter a binding contract where you live. If you are using meHappy on behalf of an organisation, you confirm you are authorised to bind it to these terms.

Your account is your phone number, confirmed by an SMS code; there is no password. The name and photo you choose are shown to your friends. You can delete the account from the app's settings; deletion removes your wishes, bookings and contact matches and is irreversible. Purchases stay with your Apple ID and can be restored.

Keep your phone number and device secure: anyone who can receive your SMS can sign in as you.

meHappy is a wish list among friends: add what you would love to get, see what your friends want, book a gift anonymously or chip in together in a chat, so nobody has to wonder what to give.

meHappy is not a shop and does not sell, deliver or guarantee any gift: a wish is a note between friends, a booking is a promise between people, and chipping in is an arrangement you make among yourselves. The app does not hold or transfer money for a shared gift.

You keep every right in the wishes, photos and messages you add. By adding them you let us store them and show them to your friends on meHappy, which is the point of the app. Keep wishes and messages lawful and respectful; we may remove content that is reported and plainly abusive.

You must not:

• Attempt to gain access to another user's account, data or key material.
• Probe, scan or test the vulnerability of our systems without our prior written consent, or otherwise interfere with their operation.
• Use automated means to create accounts or place load on the service beyond normal app use.
• Reverse engineer, decompile or disassemble the app, except to the extent that applicable law expressly permits it despite this restriction.
• Resell, sublicense or make the service available to third parties as your own.
• Sign up with a phone number that is not yours, or upload contacts you have no right to share.

We may suspend or terminate an account that breaches this section.

meHappy is free to download. The free profile holds a limited number of gifts; one-time purchases extend it to 12, 24 or 36 gifts. The exact price for your region and currency is shown on the purchase screen before you confirm.

Payment is charged to your Apple App Store account on confirmation of purchase; we never receive or handle your payment details. One-time purchases do not renew. Restore Purchases in the app reattaches them to a new device signed in with the same store account.

Refunds are handled by Apple under its own policies. We cannot issue a refund for a store purchase. Where you have a statutory right of withdrawal under consumer law in your country, that right is unaffected by this section.

Where you obtained meHappy from the Apple App Store, the following applies and prevails over anything inconsistent elsewhere in these terms:

• This agreement is between you and Sport Star Management LLC only, not with Apple. We, not Apple, are solely responsible for meHappy and its content.
• Apple has no obligation to furnish any maintenance or support for meHappy.
• If meHappy fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
• Apple is not responsible for addressing any claim by you or a third party relating to meHappy, including product liability, failure to conform to legal requirements, and consumer protection or privacy claims.
• Apple is not responsible for the investigation, defence, settlement or discharge of any third-party claim that meHappy infringes intellectual property rights.
• You confirm you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.

We aim to keep meHappy available, but we do not guarantee uninterrupted service. We may suspend it for maintenance, and we may change or discontinue features. If we discontinue the service altogether, we will give you reasonable notice in the app or by any other means we have.

You may stop using meHappy at any time and delete your account from within the app; deletion is irreversible. We may suspend or terminate your access if you breach these terms, if we are legally required to, or if continuing would expose us or other users to material risk. Except where a breach makes it inappropriate, we will give notice first.

To the fullest extent permitted by law, meHappy is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that meHappy will be uninterrupted or error-free.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, and for fraud. If you deal as a consumer, your statutory rights are unaffected.

Subject to the section above, to the fullest extent permitted by law:

• We are not liable for indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, goodwill or anticipated savings.
• We are not liable for any gift, booking or chip-in arrangement between users, or for money exchanged between them.
• Our total aggregate liability arising out of or in connection with these terms is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, and (b) 50 EUR.

We may update these terms. The date at the top reflects the current version. Where a change materially affects your rights, we will give notice in the app before it takes effect. Continuing to use meHappy after that point means you accept the change; if you do not, stop using the app and delete your account.

These terms are governed by the law of the Russian Federation, and disputes are resolved by the competent courts of the Russian Federation. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence, nor of the right to bring proceedings there.
